Residence permit for a minor foreign national

The right to submit an application and a set of documents for a residence permit (hereinafter, the residence permit) in the Russian Federation without first obtaining a temporary residence permit also applies to the following categories of foreign nationals:

  1. A person under the age of eighteen whose parent (adoptive parent, guardian, or custodian) is a foreign national and permanently resides in the Russian Federation.
  2. A person under the age of eighteen who is obtaining a residence permit together with their parent (adoptive parent, guardian, or custodian), who is a foreign national.

Thus, a minor foreign national may obtain a residence permit if their legal representative (parent, adoptive parent, guardian, or custodian) either already holds a residence permit in the Russian Federation or is applying to obtain one. The application for a residence permit for a child is submitted by their representative, either at the same time as the representative’s own application for a residence permit or after the representative has obtained one.

Practical example:

An Estonian citizen who holds a residence permit in Russia (for example, obtained after 12 months of residence under a temporary residence permit) is entitled to apply for a residence permit for their minor child, even if the child does not hold a temporary residence permit.

A family of citizens of Kazakhstan moves to Russia. When applying for residence permits for themselves (for example, on the basis of citizenship), the parents may also apply for residence permits for their minor children at the same time.

Document submission procedure: To obtain a residence permit pursuant to subparagraphs 2 and 3 of paragraph 2 of Article 8 of Federal Law No. 115-FZ of 25.07.2002 “On the Legal Status of Foreign Citizens in the Russian Federation”, the legal representative of the minor foreign national must apply to the territorial office of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of Russia at the place of stay.
